What is Indiana uninsured and underinsured motorist law?

Under Indiana law, all drivers must carry auto insurance. Unfortunately, not everyone obeys the law, and you may find the driver who caused your accident has no insurance. Even so, for those who carry auto insurance, Indiana law requires insurance companies to include uninsured and underinsured motor vehicle coverage. Therefore, unless you rejected the inclusion in your insurance, your policy should cover damages caused by uninsured and underinsured motorists.

The minimum liability limits for uninsured motorists are:

  • Bodily injury up to $25,000 a person
  • $50,000 per accident
  • Property damages up to $10,000

Minimum liability limits for underinsured motorists are $50,000 for bodily injury. Of course, policy holders can purchase policies with higher limits.

When the at-fault driver has no insurance, accident victims file car accident claims with their own insurance companies to recover damages under their uninsured motorist provision.

When the at-fault driver has insurance, victims file claims with the at-fault driver’s insurance company. Depending on the extent of your personal injuries, you may find that the other driver’s policy limits do not fully cover your damages. At this point, you file with your own insurance company, which should cover the difference under the underinsured motorists provision of your coverage.
