
Under Indiana law, the general statute of limitations for filing a claim is two years. However, if you’re dealing with a governmental entity, the time frame is much shorter—typically 180 days for tort claims, with some entities allowing up to 270 days. I always advise clients to file a claim within one year of the injury. If you don’t name a non-party (someone else who might be responsible), you could lose the chance to hold them accountable. Insurance companies and defense attorneys will point fingers at others if given the opportunity, so it’s critical to file within the statute of limitations to ensure your case is protected.
