Under Indiana law, we have a system called comparative fault, where the fault of all parties involved is compared, including any nonparties. If a governmental entity is involved, there may also be contributory negligence claims. As long as you are not more than 50% at fault, you can still recover damages. However, the amount of damages awarded by a jury will be reduced by the percentage of fault assigned to you. Please give us a call with any questions you may have.
